EXECUTIVE SUMMARY

This approximately 3.21-acre tract of land is currently zoned into the General Commercial (GC) District.  The landowner is requesting that the property be rezoned into the Downtown District (DD) for the purpose of constructing single-family (for sale) high-end luxury townhomes and their associated amenities, as allowed by right within the Downtown District.  The property is generally located along Bois D’Arc Rd. and Fulshear Run Trace.  The proposed development looking to rezone into the Fulshear Run PUD was brought to the Planning and Zoning Commission in January of 2024 and was unanimously recommended for denial.

Since that time the developer and his team have resubmitted a proposal comprised of only minor changes including a request to rezone into the Downtown District as opposed to the Fulshear Run P.U.D., materials, and change in roof design.  The overall site plan seems to be nearly identical to that of the original submission.

Staff recommended that should the developer seek a change in the zoning district for a townhome development, the best chance would be to request a rezone into the Downtown District.  The expectation from staff rests in the fact that the Downtown District has rules and regulations that encourage walkability in addition to promoting an exterior appearance that is more in line with the vision that the City of Fulshear has for this particular area.  The proposed site plan does not incorporate any commercial aspect within the development, does not encourage walkability, nor does it contain any park space that would help the proposal meet the mixed-use requirements within the Coordinated Development Ordinance. Thus, the rezoning of this property from general commercial (GC) to the Downtown District would not meet the goals of the City’s Comprehensive Plan, nor potentially the minimum standards of the Downtown District.  I have included the presentation provided by the developer and his team for your review.

RECOMMENDATION

This proposal was taken to the Planning and Zoning Commission on 04.05.24 and was unanimously recommended for denial for the second time.  Additionally, staff recommends that the rezone request be denied.
