City staff and the Waters Group (L.A. Waters and Mason Investments, LLC) met to discuss the mutual benefits of entering into an agreement to address the needs of the Waters Group and the City for drainage, remote water well site(s), and a sanitary sewer easement.
The City's needs:
1. remote water well site(s)
2. Sanitary Sewer Easement to serve north development flows to Lift Station 10 located on FM 1093 near Polo Ranch
Waters group needs
1. Drainage structure constructed between their eastside development near Del Webb and the drainage system through the Del Webb Community
2. Coordinating agreement with the Texas Department of Transportation (TxDOT) for a Local On System Project Improvement (ownership of the structure once constructed) better known as a LOSA
Staff and the Waters Group have determined the proposed needs of both parties are in line with the goal to provide regional drainage, improved water system capacities, and regional wastewater system capacity flows.
In addition, the City of Fulshear will need an agreement for a Local On System Improvement Project (LOSA) for the proposed drainage system construction to serve as regional drainage for the development on FM 359 near the Del Webb Community. The LOSA requires the City of Fulshear to approve a Resolution approving the agreement with TxDOT.
The Development Agreement, Resolution 2024-639, and Draft LOSA have been reviewed by Legal and staff.
